The overall objective of this project is to promote a change in policy, both in Belgrade and Pristina, in relation to property restitution in Kosovo. This will be done through a series of consultations in Belgrade, Pristina and Brussels with NGOs and policy makers. The project has a direct relation with a long term program implemented by IKV Pax Christi and Fractal, Enclavia, which is a self advocacy program for Serbs living in Kosovo enclaves.

Property Restitution to minorities and majorities that were replaced during the conflict is essential for sustainably peace in Kosovo. Currently, both Serbian and Kosovo authorities do not make full efforts to ensure property restitution, nor is this a top priority for the international community active in Kosovo. Thus the property of minority communities and particularly of Kosovo Serbs is still occupied and not available for residential or commercial use.

The problem addressed is both technical and political: Serbian and Kosovar governments don`t communicate or cooperate to solve this issue because Serbia has shut off all communication with Kosovo after its declaration of independence. But there are also many technical problems that should be addressed. Some of these problems are:
  • Lack of cooperation and coordination between KPA and Judiciary and the Police in preventing and prosecuting cases in field of property rights;
  • Lack of appropriate measures of municipal officials, as well law enforcement agencies and the courts to remedy and prevent illegal construction and illegal use of agricultural and residential land of minority property right holders, including the application and enforcement of appropriate sanctions, and
  • Lack of knowledge among IDPs in Serbia about their rights and about how to access and claim their property in Kosovo.
  • Obstacles for property claimants that are residing in Serbia that need to travel to Kosovo in order to receive their decision since the closure of KPA offices in Serbia after Kosovo`s declaration of independence;
  • Obstacles for IDP`s to access to cadastral books.

Project activities:

  • Preparation of a situation report and actor mapping for Belgrade, Pristina, Brussels.
  • Meetings with a series of stakeholders to provide input for recommendations.
  • Feedback on draft recommendations by international experts on issue of property restitution.
  • Consultation in Belgrade.
  • Consultation in Pristina.
  • Consultations in Brussels.
  • Final Policy paper will be presented at press conference.
  • Monitoring of policy and implementation in relation to property restitution.
